General Terms and Conditions Referral Program

As part of the Maison Close sponsorship program, any person who knows the Maison Close brand, hereinafter referred to as the “Sponsor”, is invited to earn rewards, hereinafter referred to as the “Sponsorship Bonus”, by inviting other people, hereinafter referred to as the “Referrals”, to purchase products for a minimum amount on the website www.maison-close.com, hereinafter referred to as the “Site”. Referrals are also rewarded through the Referral Bonus.

These conditions of the Maison Close sponsorship program apply to Sponsors and Referrals, together referred to as the “Participants”.

Maison Close may suspend, terminate or modify these terms of the sponsorship program at any time and for any reason. A Sponsorship Bonus already obtained in accordance with the terms of the sponsorship program and prior to any modification, suspension or deletion, will be honored in accordance with the applicable terms then in force.

Article 1 – Organizer

This sponsorship operation is organized by the company Muse Maison Close, a simplified joint stock company, registered with the Marseille RCS under SIREN number 878760495, whose head office is located at 560 Avenue du Garlaban, 13420 Gémenos.

Any request for additional information concerning this sponsorship program, its general conditions or its implementation must be addressed to the company Muse Maison Close at the address mentioned above or via the following contact email address: satisfaction@maison-close.com.

Article 2 – Eligibility

2.1 Conditions relating to the Sponsor

The Sponsor must be of legal age, legally capable and be a natural person.

The Sponsor must be domiciled in one of the following countries: France, Canada, Belgium.

Self-sponsorship is not allowed: a Sponsor cannot sponsor themselves, or someone from the same household.

For the sponsorship to be validated, the Sponsor and the Referral must be two different people and/or not living in the same household.

There is no obligation for the Sponsor to have already placed an order with Maison Close.

2.2 Conditions relating to the Referral

The Referral must be of legal age, legally capable and be a natural person. The Referral must not be under guardianship, curatorship or legal protection.

The Referral must be domiciled in one of the following countries: France, Canada, Belgium.

The sponsorship offer is only valid if the Referral has never been a Maison Close customer at the time of their order.

A Referral can only be sponsored once and only for their first purchase.

Article 3 – Referral Bonus

The Referral Bonus can be obtained in the following ways:

• The Sponsor shares their referral link provided by Maison Close, hereinafter referred to as the “Referral Link”. The Sponsor is not authorized to use the Referral Link for paid promotions or online advertising.
• A person who has received this link, hereinafter referred to as the “Referral”, places a firm order on the Site for the first time, not subsequently cancelled, the amount of which must be greater than or equal to sixty euros (€60) after discounts.
• The Sponsor will then receive as a reward a fifteen percent (15%) discount from sixty euros (€60) of purchase by the Referral, for each Referral who places an order for the first time on the Site, without subsequent cancellation.
• The Referral will also receive a fifteen percent (15%) discount from sixty euros (€60) of purchase for their first order on the Site, without subsequent cancellation of the same order.
• The offer will be valid for thirty (30) days from the date the Sponsor forwards the invitation.
• Referral Bonuses are cumulative. Therefore, if multiple eligible referrals are made under this program, the Sponsor will receive multiple rewards. However, a Sponsor may not receive more than five (5) rewards in a twenty-four hour (24h) period, or twenty-five (25) rewards in a twelve (12) month period.
• The Sponsor will receive their Referral Bonus on the day their Referral places an order and only if the Referral does not cancel their order. If the Referral requests a refund for the order that gave rise to a Referral Bonus, the latter will be revoked, for both the Referral and the Sponsor, and must be refunded to Maison Close if it has been used in the meantime.
• In order to receive their reward, the Sponsor will be notified by email when a Referral has made a purchase. However, Maison Close will not share the nature of the product(s) purchased by the Referral with the Sponsor.
• Referral Bonuses are valid for thirty (30) days from their issue date. They cannot be combined with other discount codes or, more generally, with other current offers or promotions.
• The Sponsor and the Referral must in all cases be different people and the Maison Close sponsorship program can only be used for personal purposes and under no circumstances for commercial purposes.
• Referral Bonuses cannot be combined with current offers.

Article 4 – Display of Sponsorship Links

The Sponsor may not share or publish the Referral Link if there is no reason to believe that the recipients are able to appreciate the invitation accompanying the Referral Link. The sending must not take place in the form of spam under any circumstances.

The Sponsor must guarantee that Maison Close, its directors, officers, employees and shareholders will not be held responsible and will not be subject to complaints in the event of illegal sharing or transfer of the Sponsorship Link.

Article 5 – Protection of Personal Data

Maison Close, as data controller, processes the personal data of the Sponsor and the Referral in accordance with the provisions of the Data Protection Act No. 78-17 of 6 January 1978, as amended, and Regulation (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, the GDPR, for the purposes of the sponsorship program covered by these general terms and conditions.

The information of the Referral collected by Maison Close within the framework of the sponsorship program is intended to be processed by Maison Close for the purposes of commercial prospecting, on the basis of its legitimate interest in this regard and within the limits provided for by the regulations.

The Sponsor and the Referral have, under the conditions defined by the regulations applicable to the protection of personal data, a right of access, rectification, limitation, portability, erasure and opposition to the processing of personal data concerning them, as well as the possibility of transmitting their instructions to Maison Close in order to organize the fate of the data concerning them, including retention, erasure and communication to a third party, in the event of death.

The Sponsor and the Referral may exercise these rights by contacting Maison Close by email at satisfaction@maison-close.com or in writing at the following postal address: Muse Maison Close, 560 Avenue du Garlaban, 13420 Gémenos.

The Sponsor and the Referral also have the right to appeal to a national supervisory authority such as the National Commission for Information Technology and Civil Liberties in the event of a violation of the applicable regulations regarding the protection of personal data and in particular the GDPR.

The Sponsor and the Referral are however informed that the processing of the aforementioned personal data is mandatory to benefit from the sponsorship offer. Thus, persons who exercise the right to delete data concerning them before the sponsorship is validated will be deemed to waive their participation in said offer.

Finally, it is recalled that the Referral will be informed of the identity of their Sponsor when they are contacted and that the Referral’s data will only be used to send them the commercial offer suggested by the Sponsor. The Referral’s data may not be kept to send them other messages without having obtained their express consent.

Article 6 – Miscellaneous

Maison Close reserves the right to review any participation in the Maison Close referral program to verify that it is not associated with any fraudulent activity and may take the necessary measures to put an end to it. The Referral Bonus obtained as part of any fraudulent activity or activity contrary to the terms of the Maison Close referral program will be null and void and Maison Close may request a refund.

Maison Close may suspend, terminate or modify the terms of the Maison Close referral program at any time and for any reason.

If any section of these Terms becomes void or unenforceable, the Participants will remain bound by the remaining sections. In such case, each Participant shall at least accept a similar effect to the section declared void or unenforceable.

To the extent provided by law, the terms of the Maison Close referral program will be exclusively subject to and interpreted in accordance with French law.
