General Conditions of Use and Membership of the “CLOSE TO YOU” loyalty program

The France “Close to You” loyalty program (the “ Program ”) is developed and managed by the company Muse (Maison Close), a simplified joint stock company with capital of €128,342.00 and registered under number 878.760.495 in the Marseille Trade and Companies Register (13006) located at 167 rue de Paradis in Marseille (13006) (“ Maison Close ”).
Article 1 - Purpose and scope of validity of the Program
These general terms and conditions of use and membership (the " General Terms and Conditions of Use " or " GTC ") define the conditions of participation in the Program which allows you to accumulate points and offer Maison Close customers, making their purchases on the website:https://maison-close.com/ (the " Site ") (the " Members " or the " Member "), advantages depending on the amount spent and the frequency of purchases made on the Site.
Maison Close and the Member may hereinafter be referred to, individually or jointly, as a “ Party ” or as the “ Parties ”.
The Program is only accessible through the Maison Close Website and excluding all the stores of our partners who reseller “Maison Close” products. Thus, Members acknowledge that any purchase of “Maison Close” products ", outside the Site, will not give rise to any accumulation of points or any advantage.
The Program is not accessible to Maison Close employees.
Article 2 - Conditions and terms of membership in the Program
Membership in the Program is free.
Any membership in the Program requires the creation of a customer account as well as acceptance of these T&Cs.
The creation of a customer account and membership in the Program are conditional on the Member providing all of the following information:
- Civility (Mr/Mrs/Miss/Do not wish to specify)
- Name, First name
- Date of birth
- Email address
The creation of the customer account and membership in the Program will only be validated by Maison Close if all of the mandatory information listed above (the “ Mandatory Information ”) is provided and is, moreover, usable.
Membership in the Program will be automatic for all Maison Close customers:
- provided that they have, on the day the Program is set up, a customer account or,
- for any new creation of a customer account.
The Program is accessible on the Maison Close website, via the Member's customer account in the “My loyalty” section.
Any Member will have the possibility, via their customer account or under the conditions referred to in article 4.1 below, to terminate their membership in the Program.
The Program is personal. It is individual and nominative.
In the same way that each Member can only have one (1) customer account, each Member can only subscribe to one (1) membership in the Program.
Article 3 - Content and operating procedures of the Program
- How the Program Works
The Maison Close Loyalty Program allows each Member:
- to accumulate points when making purchases on the Site or when performing certain actions;
- to have one-off or recurring benefits described below.
The Maison Close Loyalty Program distinguishes several so-called statutory advantages corresponding to the following statuses:

Joining the Program automatically results in the Member achieving PURPLE status.
Achieving the BLACK, WHITE and GOLD levels will be based on the number of points accumulated by Members.
The accumulation of loyalty points by the Member gives him the possibility of:
- retain the level reached by him and the unique benefits and rewards associated with the level in question; and, if the conditions are met,
- reach a higher level allowing him to benefit from greater advantages; The passage to the higher level is carried out immediately upon reaching the number of points required by the level in question.
For Members who have reached the BLACK, WHITE and GOLD levels, the points accumulated will be recalculated by Maison Close on each anniversary date of the Members' entry into the level in question, i.e. every twelve (12) months. The calculation carried out by Maison Close will therefore take into account the number of points acquired over the last twelve (12) months.
If Members no longer meet the eligibility criteria for their status, they will no longer be able to claim the benefits of the status for the following year and will move down to the lower level at the time of recalculation. The Member will be informed of this by email.
Maison Close reserves the right, after having previously informed the Member on the Site or by email, to modify the points scale presented above at any time. It is specified that this modification will not give rise to any compensation from Maison Close for the Member.
- Terms of accumulation of points :
With each new purchase on the Site, Members accumulate loyalty points according to the principle 1 euro = 1 point (including delivery costs). Validated points will be available immediately after any purchase on the Site.
The accumulation of points requires the prior identification of the Member on the Site, carried out at each purchase, by identification with his customer account.
Certain actions carried out by the Member also allow points to be accumulated:
- membership in the Program: + 20 points ;
- for any new follow-up of the Instagram account “Maison Close” - https://www.instagram.com/maison_close/ in the following manner:
- The Member must log in to their customer account
- once logged in, the Member must click on “Follow us on Instagram”;
- Once on the “Maison Close” Instagram page, the Member must click on “Follow the page”: +10 points.
- Moving to a higher status:
- For the transition from PURPLE status to BLACK status: + 50 points
- For the transition from BLACK status to WHITE status: + 100 points
- For the transition from WHITE status to GOLD status: + 150 points
The purchase of a gift card also allows you to accumulate loyalty points (according to the same principle 1 euro = 1 point ). However, it is specified that the purchase of a Maison Close product on the Site using a gift card will not allow you to accumulate points .
Maison Close reserves the right to modify the points scale at any time. Information relating to the modification of the points scale will be indicated on the Member's account in the "My Loyalty" section and will be communicated by e-mail.
Points accumulated during a purchase for which the order was fully refunded will be cancelled and decredited from the Member's loyalty account.
In the event of a partial refund, only the loyalty points accumulated on the returned items will be decredited from the Member's loyalty account.
Maison Close specifies that the points issued have no market or asset value and are non-transferable.
- Validity period of points
The points accumulated by the Member are valid for twelve (12) months from the last activity carried out by the Member, namely:
- A purchase; and/or
- Any other action listed in point 2. above.
Consequently, if no purchase or action is made for twelve (12) months from the last purchase or action made, the points balance will automatically be reset to zero and the Member will benefit from PURPLE status.
- Consulting the number of points
The number of points acquired by the Member will be available in the “My Account” and “My Loyalty” sections on the Site.
The points balance can also be communicated by telephone and upon simple request by contacting Customer Service on 04 96 16 06 45.

- Accumulation of Program benefits and other discounts
Unless otherwise indicated, the offers and discounts offered under the Program cannot be combined with:
- any other offer made under the Program;
- other current offers on the Site;
Article 4 - Duration of membership in the Program
- Member’s Failure to Use the Program and Member’s Termination of Membership in the Program
In the event that the Member does not use the Program for a period of three (3) years, he/she will no longer receive commercial solicitation emails from Maison Close. Stopping the sending of commercial solicitation emails will not result in the Member's membership in the Program being terminated.
In the event that the Member wishes to terminate his/her membership in the Program, the latter may make a request to Maison Close Customer Service by:
- by sending a written request to the following address: MAISON CLOSE, MUSE company, 167 rue Paradis - 13006 Marseille; or
- calling Customer Service on 04 96 16 06 45, specifying the reason for the call.
- Blocking of customer account and suspension of membership in the Program by Maison Close
The Member undertakes to comply with these General Conditions of Use of the Program.
Maison Close reserves the right to block the Member's customer account and suspend, automatically, the Member's Membership in the Program in the following cases and conditions:
- Any fraud, suspicion of tangible fraud, abusive use of the Program and/or non-compliance with these T&Cs and in particular in the event of fraudulent, abusive and/or misappropriated use of the Program, carrying out an abnormally high number of transactions or more generally any breach of these T&Cs;
- In the event of creation by a Member of several customer accounts and/or in the event of multiple memberships to the Program.
Any suspension of a Member's membership in the Program by Maison Close for one of the aforementioned reasons will result in the Member's customer account being blocked.
Suspension of the Member's membership in the Program by Maison Close, for any of the aforementioned reasons, will result in the loss of all of the Member's rights and benefits related to membership in the Program as well as the loss of all of the history and rewards related to the Member's loyalty account.
In order to avoid any risk of fraud in the use of the Program, permanent control and monitoring methods have been put in place by Maison Close.
Article 5 - Modification or termination of the Program by Maison Close
The Program may be suspended, modified or deleted in whole or in part by Maison Close.
In the event of termination of the Loyalty Program, Maison Close will inform Members by providing information on each Member's loyalty account and by means of a dedicated communication by e-mail.
The deletion of the Program will not entitle the Member to any compensation from Maison Close.
Article 6 - Liability and limitation of liability clause
To the fullest extent permitted by applicable law, Maison Close cannot be held liable for any consequences, direct or indirect, of any malfunctions of the Loyalty Program, and in particular in the event of a malfunction resulting in a temporary inability for the Member to accumulate points granting them the right to benefits.
Maison Close undertakes, in the event of a malfunction of the Loyalty Program, to make every effort to ensure that the Member, upon presentation of all supporting documents (proof of purchases, etc.) can still benefit from its advantages.
Maison Close cannot be held liable if the non-performance or poor performance of its obligations is attributable to a case of force majeure as this term is defined by article 1218 of the civil code and case law.

Article 8 - Personal data
- Collection of the Member’s personal data
For the purposes of operating the Loyalty Program and in its capacity as Data Controller, Maison Close is required to collect personal data relating to the Member and in particular, all Mandatory Information as this term is defined in Article 2 above.
For the processing of all personal data, Maison Close uses the services of the company Yotpo Ltd, as a Subcontractor.
Mandatory Information will be collected by Maison Close via the Site when the Member creates their customer account.
In addition to collecting Mandatory Information, Maison Close may, during the Member's use of the Program, collect other personal data relating to the Member (the " Additional Information "). This Additional Information may allow Maison Close to improve its knowledge of the Member and, where applicable, to offer them a tailored experience, particularly in the context of commercial offers or special operations.
Maison Close is responsible for processing personal data.
- Exercise of the Member's rights of access, rectification and deletion of his/her personal data
In application of the General Data Protection Regulation (" GDPR ") and the Data Protection Act of January 6, 1978, each Member has an individual right to access, rectify and/or delete their personal data at any time.
To exercise his rights, the Member may:
- Modify certain of his information himself, in particular the Mandatory Information, directly via his customer account accessible on the Site;
- Delete your personal data by making a request for “modification and/or deletion” of your data by contacting Customer Service by telephone on 04 96 16 06 45 or by email at the following address: satisfaction@maison-close.com .

For the reading of this article 8, any term beginning with a capital letter and not defined in these T&Cs has the meaning given to it within the GDPR.
Article 9 - Applicable law and dispute resolution
These General Conditions of Use are subject to the application of French law.
Any dispute that may arise from the interpretation or execution of these General Conditions of Use will be brought before the competent courts.
Furthermore, and in the event that a dispute arises from the interpretation or execution of these General Conditions of Use, the Parties undertake to seek, before any legal action, an amicable solution.
In this regard, Maison Close guarantees the Member effective and free recourse to a consumer mediation system. In this respect, Maison Close has appointed the Paris Mediation and Arbitration Center as consumer mediator.
The Member is also reminded that, in accordance with Article 14 of Regulation (EU) No. 524/2013, the European Commission has set up an Online Dispute Resolution platform, facilitating the independent out-of-court resolution of online disputes between consumers and professionals in the European Union, available at this link: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=FR .
