General Terms and Conditions of Use and Membership in the "CLOSE TO YOU" Loyalty Program

The France loyalty program “Close to You” (the “ Program ”) is developed and managed by the company Muse (Maison Close), a simplified joint-stock company with a capital of €128,342.00 and registered under number 878.760.495 in the Trade and Companies Register of Marseille (13006) located at 167 rue de Paradis in Marseille (13006) (“ Maison Close ”).
Article 1 - Purpose and scope of validity of the Program
These general terms and conditions of use and membership (the " General Terms and Conditions of Use " or " GTC ") define the conditions of participation in the Program which allows Maison Close customers, making their purchases on the website: https://maison-close.com/ (the " Site ") (the " Members " or the " Member "), to accumulate points and offer benefits based on the amount spent and the frequency of purchases made on the Site.
Maison Close and the Member may be referred to hereinafter, individually or jointly, as a “ Party ” or as the “ Parties ”.
The Program is accessible only through the Maison Close website and excludes all stores of our partner retailers of "Maison Close" products. Members therefore acknowledge that any purchase of "Maison Close" products ", outside of the Site, will not result in any accumulation of points or any benefit.
The Program is not accessible to Maison Close employees.
Article 2 - Conditions and procedures for joining the Program
Membership in the Program is free.
Membership in the Program requires the creation of a customer account and acceptance of these Terms and Conditions.
The creation of a customer account and membership in the Program are conditional upon the Member providing all of the following information:
- Title (Mr/Mrs/Miss/Prefer not to specify)
- Name, Surname
- Date of birth
- Email address
The creation of the customer account and membership in the Program will only be validated by Maison Close if all the mandatory information listed above (the " Mandatory Information ") is provided and is, moreover, usable.
Membership in the Program will be automatic for all Maison Close customers:
- provided that they possess, on the date of implementation of the Program, a customer account or,
- for any new creation of a customer account.
The Program is accessible on the Maison Close website, via the Member's customer account in the "Loyalty" section.
Any Member will have the option, by contacting customer service or under the conditions referred to in article 4.1 below, to terminate their membership in the Program.
The Program is personal. It is individual and nominative.
In the same way that each Member can only have one (1) customer account, each Member can only subscribe to one (1) Program membership.
Article 3 - Content and operating procedures of the Program
- How the Program Works
The Maison Close Loyalty Program allows each Member to:
- to accumulate points when making purchases on the Site or when performing certain actions;
- to have access to the occasional or recurring benefits described below.
The Maison Close loyalty program offers several so-called statutory benefits corresponding to the following statuses:

Joining the Program automatically grants the Member PURPLE status.
Reaching the BLACK, WHITE and GOLD levels will be based on the number of points accumulated by the Members.
The accumulation of loyalty points by the Member gives them the possibility to:
- retain the tier he has reached and the unique benefits and rewards associated with that tier; and, if the conditions are met,
- to reach a higher level allowing him to benefit from greater advantages; The transition to the higher level takes place immediately upon reaching the number of points required by the level in question.
For Members who have reached the BLACK, WHITE, and GOLD tiers, accumulated points do not expire. They remain valid indefinitely, without any recalculation by Maison Close.
Maison Close reserves the right, after informing the Member beforehand on the Website or by email, to modify the points system presented above at any time. It is specified that this modification will not entitle the Member to any compensation from Maison Close.
- Methods for accumulating points :
With each new purchase on the Site, Members accumulate loyalty points on a basis of 1 euro = 1 point (including delivery charges). Points earned will be available immediately after any purchase on the Site.
Accumulating points requires prior identification of the Member on the Site, which is done at each purchase, by identifying themselves through their customer account.
Certain actions performed by the Member also allow them to accumulate points:
- Program membership: + 20 points;
- Make a second purchase: + 30 points;
- Subscribe to the Newsletter as follows:
- The member will need to log in to their customer account.
- Once logged in, the Member will need to enter their email address in the website footer, in the box "Join us » and click on the arrow to validate: + 20 points;
- transition to a higher status:
- For upgrading from PURPLE status to BLACK status: + 50 points
- For upgrading from BLACK status to WHITE status: + 100 points
- For upgrading from WHITE status to GOLD status: + 150 points
- For any new followers of the Instagram account "Maison Close" - https://www.instagram.com/maison_close/ - please follow these steps:
- The member will need to log in to their customer account.
- Once logged in, the Member will need to click on "Follow us on Instagram";
- Once on the Instagram page “@maison_close”, the Member must click on “Follow the page”: + 10 points.
- For any new followers of the TikTok account "Maison Close" - https://www.tiktok.com/@maisoncloseofficial - please follow as follows:
- The member will need to log in to their customer account.
- Once connected, the Member will have to click on "Follow us on Tiktok";
- Once on the TikTok page “maisoncloseofficial”, the Member must click on “Follow”: + 10 points.
- For any new follower of the Pinterest account "Maison Close" - https://fr.pinterest.com/maisonclose/ , please use the following method:
- The member will need to log in to their customer account.
- Once logged in, the Member will need to click on "Follow us on Pinterest";
- Once on the "maisonclose" Pinterest page, the Member must click on "Subscribe": + 10 points.
Purchasing a gift card also allows you to accumulate loyalty points (according to the same principle : 1 euro = 1 point ). However, it should be noted that purchasing a Maison Close product on the Site using a gift card will not allow you to accumulate points .
Maison Close reserves the right to modify the points system at any time. Information regarding changes to the points system will be indicated in the Member's account under the "Loyalty" section and will also be communicated by email.
Points accumulated during a purchase that has been subject to a full refund of the order will be cancelled and deducted from the Member's loyalty account.
In the case of a partial refund, only the loyalty points accumulated on the returned items will be deducted from the Member's loyalty account.
Maison Close specifies that the points issued have no commercial or patrimonial value and are non-transferable.
- Validity period of points
The points accumulated by the Member are not subject to any expiry date.
- Checking the number of points
The number of points acquired by the Member will be available in the customer account, under the "Loyalty" section on the Site.
The points balance can also be communicated by telephone and upon simple request by contacting Customer Service .

- Accumulation of Program benefits and other discounts
Unless otherwise stated, offers and discounts provided under the Program cannot be combined with:
- any other offer proposed within the framework of the Program;
- other current offers on the Site;
Article 4 - Duration of membership in the Program
- Member's failure to use the Program and termination of their membership in the Program by the Member
If the Member does not use the Program for a period of three (3) years, they will no longer receive marketing emails from Maison Close. Stopping the sending of marketing emails will not result in the termination of the Member's Program membership.
Should the Member wish to terminate their membership in the Program, they may submit a request to Maison Close Customer Service by:
- by sending a written request to the following address: MAISON CLOSE, MUSE company, 167 rue Paradis - 13006 Marseille; or
- calling Customer Service at 04 96 16 06 45 and specifying the reason for the call
- by contacting customer service by email at the following address: dpo@maison-close.com
- Maison Close has blocked the customer account and suspended their membership in the Program.
The Member agrees to comply with these General Terms and Conditions of Use of the Program.
Maison Close reserves the right to block the Member's customer account and automatically suspend the Member's Membership in the Program under the following cases and conditions:
- Any fraud, suspicion of tangible fraud, misuse of the Program and/or use not in accordance with these Terms and Conditions, and in particular in the event of fraudulent, abusive, and/or misappropriated use of the Program, carrying out an abnormally high number of transactions or more generally any breach of these Terms and Conditions;
- In the event of the creation by a Member of several customer accounts and/or in the event of multiple memberships in the Program.
Any suspension of a Member's membership in the Program by Maison Close for one of the aforementioned reasons will result in the blocking of the Member's customer account.
The suspension of the Member's membership in the Member Program by Maison Close, for one of the aforementioned reasons, will result in the loss of all the Member's rights and benefits related to membership in the Program as well as the loss of all history and rewards related to the Member's loyalty account.
To avoid any risk of fraud in the use of the Program, permanent control and monitoring measures have been put in place by Maison Close.
Article 5 - Modification or termination of the Program by Maison Close
The Program may be suspended, modified or cancelled in whole or in part by Maison Close.
In the event of the termination of the Loyalty Program, Maison Close will inform Members by providing information on each Member's loyalty account and by sending a dedicated email.
The cancellation of the Program will not entitle the Member to any compensation from Maison Close.
Article 6 - Liability and Limitation of Liability Clause
To the fullest extent permitted by applicable law, Maison Close shall not be held liable for any consequences, direct or indirect, of any malfunctions of the Loyalty Program, and in particular in the event of a malfunction resulting in a temporary inability for the Member to accumulate points granting him the right to benefits.
Maison Close undertakes, in the event of a malfunction of the Loyalty Program, to make every effort to ensure that the Member, upon presentation of all supporting documents (proof of purchase etc.) can still benefit from its advantages.
Maison Close cannot be held liable if the non-performance or poor performance of its obligations is attributable to a case of force majeure as defined by Article 1218 of the Civil Code and case law.
Article 7 - Complaints and information

Article 8 - Personal Data
- Collection of the Member's personal data
For the purposes of the operation of the Loyalty Program and in its capacity as Data Controller, Maison Close is required to collect personal data relating to the Member and in particular, all Mandatory Information as defined in Article 2 above.
For the processing of all personal data, Maison Close uses the services of the company Yotpo Ltd, as a Subcontractor.
The Mandatory Information will be collected by Maison Close via the Site when the Member creates their customer account.
In addition to collecting the Mandatory Information, Maison Close may, during the Member's use of the Program, collect other personal data relating to the Member (the " Additional Information "). This Additional Information may allow Maison Close to improve its understanding of the Member and, where applicable, to offer them a tailored experience, particularly in the context of commercial offers or special promotions.
Maison Close is responsible for the processing of personal data.
- Member's right to access, rectify and delete their personal data
In accordance with the General Data Protection Regulation (“ GDPR ”) and the French Data Protection Act of 6 January 1978, each Member has at any time an individual right to access, rectify and/or delete their personal data.
To exercise their rights, the Member may:

For the purposes of reading this article 8, all terms beginning with a capital letter and not defined in these Terms and Conditions have the meaning given to them in the GDPR.
Article 9 - Applicable Law and Dispute Resolution
These General Terms of Use are subject to French law.
Any dispute arising from the interpretation or execution of these General Terms of Use shall be brought before the competent courts.
Furthermore, in the event that a dispute arises from the interpretation or execution of these General Terms of Use, the Parties undertake to seek an amicable solution before any legal action.
In this regard, Maison Close guarantees Members effective and free access to a consumer mediation service. To this end, Maison Close has appointed the Paris Mediation and Arbitration Centre as its consumer mediator.
The Member is also reminded that, in accordance with Article 14 of Regulation (EU) No 524/2013, the European Commission has set up an Online Dispute Resolution platform, facilitating the independent out-of-court settlement of online disputes between consumers and professionals in the European Union, available at this link: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=FR .
